Terms of Service

By accessing or using PorchDeals ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all users including buyers, sellers, and visitors.

You must be at least 18 years old to use PorchDeals. By using the Platform, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not create accounts for fraudulent purposes, impersonate other users, or use another person's account without permission.

PorchDeals is a venue that connects buyers and sellers. We are not a party to any transaction between users. You are solely responsible for the accuracy of your listings and for completing transactions you agree to.

By posting a listing, you represent that you have the right to sell the item, the item is accurately described, and the listing complies with all applicable laws.

PorchDeals does not process payments between users. All payment arrangements are made directly between buyers and sellers.

While PorchDeals does not process direct payments between buyers and sellers for goods, we do process payments for optional services such as listing boosts and subscription plans through Stripe.

The following are prohibited on PorchDeals:

• Illegal items or services of any kind
• Drugs, controlled substances, marijuana products (including in states where legal), CBD products requiring regulation, prescription medications, drug paraphernalia
• Firearms, ammunition, explosives, weapons (including knives marketed as weapons), or weapon accessories
• Counterfeit, replica, or stolen goods
• Alcohol or tobacco products
• Adult content, sexual services, or escort services
• Live animals
• Hazardous materials, chemicals, or biohazards
• Items that infringe intellectual property rights
• Recalled products
• Fraudulent listings, scams, or deceptive practices
• Harassment, threats, hate speech, or abusive conduct toward other users
• Spam, phishing, or unsolicited commercial messages
• Off-platform redirection (attempts to move conversations to external messaging or payment systems)

Violation of these prohibitions may result in immediate account termination.

We may proactively screen content for prohibited items, but this does not guarantee all violations are caught. Users are responsible for ensuring their listings comply with these terms and applicable laws. Suspected violations should be reported using the in-platform reporting tools.

PorchDeals offers optional paid services including listing boosts and Pro subscription plans. Payments are processed securely through Stripe.

Listing Boosts: Boost fees are charged at the time of purchase and are non-refundable once a boost has been activated. Boost durations are calendar-based from the time of purchase. If a listing is removed (whether by you, by us for terms violation, or due to account termination) during an active boost period, no refund is issued.

Subscription Plans: Pro subscriptions are billed monthly or annually as selected at signup. You may cancel your subscription at any time, and cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods. We reserve the right to modify pricing with reasonable advance notice to active subscribers.

Chargebacks: Initiating a chargeback for legitimately rendered services may result in immediate account termination.

By posting content on PorchDeals, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for the purposes of operating the Platform.

You retain ownership of your content. You represent that you own or have the rights to all content you post, including photos.

We reserve the right to remove any content at our discretion, including content that violates these Terms, applicable law, or our community standards. We are not obligated to host or display any user content.

DMCA Compliance: If you believe content on PorchDeals infringes your copyright, please refer to our Privacy Policy for information on submitting a DMCA takedown notice.

We employ both automated and manual content moderation. We reserve the right to remove listings, messages, comments, profile content, or any other user-generated content that we determine, in our sole discretion, violates these Terms or our community standards. We may also restrict, suspend, or terminate accounts that engage in prohibited conduct.

Repeated violations may result in permanent ban without refund of any active subscriptions or boosts.

You agree not to: (a) use the Platform for any unlawful purpose; (b) interfere with or disrupt the Platform's operation; (c) attempt to gain unauthorized access to any part of the Platform; (d) use bots, scrapers, or automated tools to access the Platform without our express written permission; (e) circumvent any technical measures we use to limit access; (f) collect personal information about other users without their consent; or (g) use the Platform to send unsolicited commercial communications.

PorchDeals is provided "as is" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We do not verify the accuracy of user listings or the identity of users.

We do not endorse any user, listing, or transaction. Your interactions with other users are entirely at your own risk.

PorchDeals shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or any transactions conducted through it. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

In no event shall PorchDeals be liable for the actions, conduct, or content of users, including transactions conducted between users, items received or not received, or disputes between buyers and sellers.

You agree to defend, indemnify, and hold harmless PorchDeals and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any content you post; or (e) any transaction you conduct through the Platform.

Termination by You: You may delete your account at any time through your account settings. Upon deletion, your listings will be removed and your data will be handled in accordance with our Privacy Policy.

Termination by Us: We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

Effect of Termination: Upon termination of your account: (a) any active boosts or subscriptions are forfeited without refund; (b) your listings will be removed from the Platform; (c) your account data will be handled per our Privacy Policy; (d) provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall remain in effect.

Informal Resolution: Before filing any formal claim, you agree to attempt to resolve disputes with PorchDeals through good-faith negotiation by contacting us through our Contact page. Most disputes can be resolved this way.

Arbitration: Any disputes that cannot be resolved informally shall be settled by binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Paulding County, Georgia. You and PorchDeals waive the right to a jury trial and to participate in class action lawsuits.

Exceptions: Either party may bring an individual claim in small claims court for qualifying matters.

These Terms shall be governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Paulding County, Georgia.

We may update these Terms at any time. Continued use of PorchDeals after changes constitutes acceptance of the new terms. We will make reasonable efforts to notify users of significant changes.
